6.1 The weather data — VERIFIED

6.2 The arithmetic that kills 70 days

There are only 60.6 weekend days in an October–April season. 70 operating days is
therefore impossible on a weekend-only Oct–Apr calendar before a single drop of rain.
To physically reach 70 you would need a Sep–May nine-month season (78 weekend days) and
to sell 90% of them regardless of weather — 38 °C days included.

Worst months are Jan–Feb (22–23% of days hit ≥35 °C) and Jun–Aug (~33% rain days).
March and April are the best riding months of the year.

6.3 Fire bans

Total Fire Bans are declared on Extreme or Catastrophic rating days. CFS publishes no
per-district historical count

weekends, most already inside the ≥35 °C exclusion.

Local precedent that an operator shuts: the Clare Valley Wine, Food & Tourism Centre
publishes that it is "Closed on Christmas Day and Catastrophic Fire Days" — VERIFIED
(clarevalley.com.au). Putting inexperienced riders
15 km from a car on a Catastrophic day is uninsurable in practice.

6.4 ⚠️ The counter-intuitive demand finding: winter is not dead for the region

Visitation is almost flat. Winter is 24% of Clare's overnight visitors versus 22% for
summer. SATC's own commentary: "May and October are the strongest months… in the Clare
Valley"
; "May and November are the strongest… in the Barossa."

May — a month the Oct–April season excludes — is one of the two peak visitation months
in both regions.
Winter is not dead for the region; it is dead for cycling. That is a
constraint the product imposes on a market that is there year-round, and it is the single
biggest strategic tension in the business. Extending into May and September is worth
~$8,600 of EBIT per 6.6 days (see the The numbers, sensitivity and scenarios
chapter) and should be the first operational priority after break-even.

6.5 ⚠️ SA law makes the bail-out mandatory — VERIFIED, and it is worse than a fine

Road Traffic Act 1961 (SA) s 5: "vehicle includes— … (b) a bicycle."
s 47(1): a person must not drive a vehicle "while so much under the influence of
intoxicating liquor… as to be incapable of exercising effective control."

  • Fine: $500 for a non-motor vehicle (s 47 Penalty (b)) — VERIFIED
  • No court disqualification for a bicycle (s 47(3) is limited to motor vehicles) — VERIFIED
  • s 47B (the 0.05 offence) does NOT apply to bicycles — it says "motor vehicle."
    There is no BAC limit and no breath-test offence for a cyclist in SA; police must prove
    actual incapacity — VERIFIED
  • ⚠️ BUT SIX DEMERIT POINTS ATTACH TO THE RIDER'S CAR LICENCE. Motor Vehicles
    Regulations 2010
    (SA) Sch 4 Pt 2 cl 4 lists s 47(1) — "vehicle" — 6 points, while
    the very next line (s 47(1a)) says "motor vehicle". The distinction is deliberate.

The SA Government says it in plain English in its own booklet
(Cycling & the Law, DPTI, VERIFIED):

"This is a criminal offence, and upon conviction you will be fined and will
consequently have a criminal record. You may also lose up to six demerit points
from your driver's licence… and potentially lose your licence
… You can be fined or
convicted… regardless of whether you are over or under the 0.05."

Six points is half a full licence. Victoria has no equivalent standalone offence.

Three consequences, all of which cost money:

  1. The van bail-out is a compliance control, not a nice-to-have. It must be in the
    price, the T&Cs and the marketing copy. It sets a hard minimum vehicle capacity:
    the van must be able to take any rider plus their bike at any stop.
  2. Rewrite the sales pitch. "We'll drive you and the bikes back, no questions, no
    charge"
    is now the feature, not the fallback. This is also the honest answer to
    "why not just hire a bike from a shop?"
  3. ⚠️ It cuts both ways on insurance, and probably against you. A guided operator can
    physically stop a drunk rider mounting a bike. You cannot. SA law now puts it beyond
    argument that you knew riders would be drinking and knew it was an offence — which
    is precisely the "aware of a significant risk… without adequate justification"
    formulation in the s 139A recklessness carve-out (§5.6 in the insurance chapter).
    Documented, logged refusal-of-service is the mitigation that makes this defensible.
    No operator anywhere in the world publishes an alcohol policy; you will be writing one
    from scratch, and your broker will want to read it.
