Germany, drink-cycling — verified against a primary document

64. Deutscher Verkehrsgerichtstag position paper (28–30 January 2026, Arbeitskreis
II: "Alkoholisiert auf Fahrrädern und Pedelecs", ACE Auto Club Europa) [V]:

  • ≥1.6 ‰ = absolute Fahruntüchtigkeit, a Straftat under §316 StGB, regardless of
    riding errors: "Nach aktueller Rechtsprechung wird eine absolute Fahruntüchtigkeit
    für Radfahrende ab 1,6 Promille angenommen. Ab diesem Wert liegt eine Straftat vor –
    unabhängig von konkreten Ausfallerscheinungen."
    Consequences: fine or imprisonment
    up to one year, MPU (Fahreignungsprüfung), and possible Entzug der Fahrerlaubnis.
  • 0.3–1.59 ‰ = relative Fahruntüchtigkeit where alcohol-typical
    Ausfallerscheinungen are present.
  • Crucially: "Damit existiert für Radfahrende bislang keine bußgeldrechtliche
    Promillegrenze
    , sondern ausschließlich die strafrechtliche Sanktion bei
    Fahruntüchtigkeit."
  • ADFC and ADAC corroborate [V]: "Eine Blutalkoholkonzentration ab 1,6 Promille

Live regulatory risk — this is about to change, and it targets exactly this product [V]

  • Pedelec alcohol accidents rose from 100 (2015) to 1,735 (2024) — +1,635%.
    Cyclists' share of alcohol-impaired accident causers rose from 22% (2004) to 43%
    (2024)
    . Bike + pedelec alcohol accident involvement is up 49% in ten years while
    car alcohol accidents fell 13% (7,553 → 6,606). Bike, pedelec and e-scooter combined
    now account for 6,494 alcohol-impaired accident participants versus 6,606 for cars
    — parity. 441 cyclists died on German roads in 2024, +11.4% since 2014.
  • The ADFC proposes a 1.1 ‰ Gefahrengrenzwert as a Bußgeldtatbestand [V]:
    "Der Gesetzgeber sollte auch für Radfahrende einen zusätzlichen Gefahrengrenzwert von
    1,1 Promille als Bußgeldtatbestand"
    — citing that 83% of injured intoxicated
    cyclists had ≥1.1 ‰
    . The VGT endorsed this in 2015; the Bundesverkehrsministerium
    rejected it, citing falling accident numbers — a justification the ACE says the data
    has now overturned.
  • The ACE backs the same 1.1 ‰ threshold at the 2026 VGT, proposing three tiers:
    <1.09 ‰ no sanction (Eigenverantwortung); ≥1.1 ‰ Ordnungswidrigkeit with Geldbuße
    under a new §24a StVG, no criminal record; ≥1.6 ‰ Straftat under §316 StGB with MPU
    and possible licence loss.

An operator selling three wine tastings then putting guests on public roads is
operating in a regime that a major motoring club and the national cycling federation
are both actively lobbying to tighten.
The largest self-guided cycling market on
earth is moving against drink-and-ride. That is a genuine medium-term risk to the
Australian concept's core premise, and it belongs on the risk register even though
Australian law is currently permissive.

Austria [V, ÖAMTC / oesterreich.gv.at]

Cyclist limit 0.8 ‰ / 0.4 mg per litre of breath. Helmet compulsory under 12.
Pedelec = bicycle at ≤250 W and ≤25 km/h. Fines €800–3,700 from 0.8 ‰,
€1,200–4,400 from 1.2 ‰, up to €5,900 at higher levels, with possible car-licence
consequences on Verkehrszuverlässigkeit grounds [V-2°: autorevue, VCÖ, ffcheck].
ÖAMTC notes fines are income-dependent, roughly one month's net salary.

Germany, vehicle classification [V-2°]

Pedelec ≤25 km/h, ≤250 W = a bicycle (no insurance, no licence, no helmet, must use
Radwege). S-Pedelec ≤45 km/h = Kleinkraftrad (insurance plate, licence class AM,
helmet mandatory, may not use Radwege). Throttle e-bikes = Mofa.

Practical implication: keep any fleet at 25 km/h pedelec spec or the product
acquires licensing, insurance and route restrictions.

The ACE paper adds that Elektrokleinstfahrzeuge (e-scooters) are legally
Kraftfahrzeuge
, so car-level limits, Bußgelder and licence consequences apply to them
— a sharp contrast with bicycles that catches users out.

Pauschalreise law — §651a BGB [V, gesetze-im-internet.de, official]

The nuance that matters most: bike hire is NOT category 3 (four-wheeled motor
vehicles and motorcycles). Bike hire falls under category 4, "jede andere touristische
Leistung"
, which triggers the 25% rule — ancillary services make a Pauschalreise
only where they are ≥25% of value or are advertised as an essential characteristic
of the trip
.

A supported bike-and-wine holiday marketed on the bike and the support is almost
certainly a Pauschalreise via the "essential characteristic" limb, even if the value
test would not catch it.

§651a(5) excludes trips under 24 hours with no overnight stay costing ≤€500 — which
is why day products escape. §651r then requires insolvency security, normally via a
Reisesicherungsfonds (insurer or bank permitted under €10m turnover), evidenced by a
Sicherungsschein. A genuine fixed cost of bundling accommodation + bike + support
in Germany
— and another reason the Australian decision to leave accommodation out is

Guide licensing

No operator in this scan publishes any guide-licensing requirement or cost [GAP].
Self-guided products avoid the question entirely, which may be part of the category's
appeal.

Waivers and liability caps [V]

Zoom Leisure caps total liability at $100 and requires a full release; Macs
Adventure and Headwater/Exodus both cap at three times the price paid for non-injury
claims; Donau Touristik caps transport-bus liability at €1,000 pp; Freedom Bike Shop
sells a $25 damage waiver covering $250; Grape Escape sells $10 + HST cancellation
insurance
. Travel insurance is mandatory at Macs Adventure.

The universal silence

Not one operator's AGB or T&Cs — Radweg-Reisen, Eurobike, Velociped, Austria
Radreisen, or any anglophone operator — mentions alcohol at all
, despite these being
wine tours with three tastings included [V — absence]. They use generic clauses
shifting road-rule compliance to the traveller (Eurobike: "Die Einhaltung der
Straßenverkehrsordnung liegt in der Verantwortung des Reisenden"
).

The only operators that address alcohol directly are the two Canadian day operators —
Zoom Leisure prohibits riding under the influence outright, and Grape Escape
requires guests to "drink responsibly" on pain of removal without refund.

In a category whose entire premise is drinking and cycling on the same day, this is
a conspicuous and near-universal gap — and, given the German legislative direction, a
foreseeable one to close.
The two workable templates in the world are therefore
Canadian: an outright prohibition (Zoom, which is arguably unenforceable and
contradicts its own product) or a conduct standard with a removal remedy (Grape
Escape). Grape Escape's is the better model.

Failures, exits and consolidations

  • Brandner Schifffahrt has ceased scheduled Wachau services
  • Donau Touristik has broken TLS across all four hostnames and has lost
    donauradweg.at to the regional tourism board

  • Inntravel and Explore into DERTOUR / REWE
